Driver’s Guide: What Happens If I’m Pulled Over Without Proof of Insurance in Florida?
Florida drivers have to keep proof of their required PIP and property damage coverage with them and show it when an officer asks. Under section 316.646, that proof can be on paper or in an approved electronic format on your phone. Failing to show it is a nonmoving traffic infraction, not a crime (s. 316.646).
If you were actually insured and just couldn’t show the card, Florida law lets the clerk dismiss the ticket when you bring proof of coverage that was valid at the time of the stop, for a fee of up to $10 (s. 318.18(2)(b)). In Palm Beach County, for example, the Clerk asks for that proof within 30 days of the citation date, and the insurance card has to match the vehicle on the ticket (Palm Beach Clerk). Miami-Dade and Broward drivers should check with their county clerk for the local process.
It’s a different story if you had no coverage at all. If you’re charged as the owner and can’t show the court that insurance was in effect, the court can tell FLHSMV to suspend your license and registration (s. 316.646(3)).
What this means for you: Keep a digital copy of your insurance card on your phone. If you get this ticket, don’t just pay it. If you were insured, it can usually be dismissed for a small fee.

Common Questions
I left my driver’s license at home. Is that a big deal?
Florida law requires you to carry your license while driving and show it on request. Not having it on you is a nonmoving infraction (s. 322.15). If you had a valid license at the time, the clerk can dismiss the ticket for a fee of up to $10 (s. 318.18(2)(b)).

What happens if my car insurance lapses in Florida?
Every Florida-registered vehicle needs at least $10,000 in PIP and $10,000 in property damage liability. A lapse can lead to suspension of both your license and your plate, and no hardship license is available for insurance suspensions (FLHSMV). Reinstatement costs $150 the first time, $250 the second, and $500 for each one after that within three years (s. 324.0221).
What this means for you: If you’re selling a car or taking it off the road, FLHSMV says to turn in the plate before you cancel the insurance.

Can kids ride in the back of a pickup truck in Florida?
On limited-access highways, a driver can’t let anyone under 18 ride in an open pickup or flatbed bed unless they’re in secured seating with restraints. Exceptions include medical emergencies with an adult present and parades or exhibitions. A violation is a nonmoving infraction (s. 316.2015).

Do no-insurance or no-license tickets put points on my license?
Failing to show proof of insurance (s. 316.646) and failing to carry your license (s. 322.15) are both nonmoving infractions. Florida’s point system applies to moving violations (FLHSMV points FAQ). Knowingly showing proof of insurance that isn’t in force is different: that’s a first-degree misdemeanor.
