Driver’s Guide: How Do I Get My License Back After It’s Suspended for an Unpaid Ticket in Florida?

If you miss the deadline to pay or contest a Florida traffic ticket, the county clerk notifies the state within 10 days. The Department of Highway Safety and Motor Vehicles (FLHSMV) then issues a suspension order that takes effect 20 days after it is mailed (Florida Statutes s. 318.15(1)(a)). This kind of suspension lasts until you deal with the ticket. It doesn’t simply run out.

To clear it, contact the traffic court in the county that issued the ticket (Miami-Dade, Broward, Palm Beach or elsewhere) and either pay what you owe or set up a payment plan with the clerk. The county then sends a clearance (often called a D-6 clearance) to FLHSMV, and you pay a $60 reinstatement fee (s. 318.15(2)). You can pay that fee at a driver license office, by mail, or by phone through FLHSMV, unless the court collects it for you. FLHSMV also says court suspensions are not eligible for a hardship license.

What this means for you: Check your status on FLHSMV’s free online license check before you drive. The suspension stays on your record for 7 years, but you may still have options to contest the original ticket.

Common Questions

My license was suspended for not paying. Can I still fight the ticket?
Often, yes. Florida law lets you request a hearing within 180 days of the violation date even after a failure-to-pay suspension (s. 318.15(1)(c)). In Miami-Dade, a late hearing request between 31 and 180 days comes with a $16 late fee.

Can I get a hardship license while I sort it out?
No. FLHSMV says suspensions for traffic citations or court requirements are not eligible for a hardship license. The way back is to satisfy the ticket and pay the reinstatement fee.

Why won’t the state renew my tag? I have an old red-light camera ticket.
If a red-light camera citation goes unpaid, Florida law lets FLHSMV refuse to issue a license plate or registration sticker for vehicles you own or co-own until the amount is paid (s. 318.15(3)).

What is Miami-Dade’s Drive Legal Program?
It’s a court program for drivers suspended over unpaid or missed Miami-Dade tickets. It offers payment plans, community service in place of some fines, and traffic school, and it withholds two-thirds of the points on moving violations. Enrollment is $200, the program normally takes 90 days, and commercial (CDL) license holders aren’t eligible. It covers only Miami-Dade citations, so Broward and Palm Beach tickets have to be handled with those clerks.
